General Terms and Conditions for Essence of Light Photographic Workshops at Swinton Park

 

DEFINITIONS

1.1 Workshops are offered by Jed Wee trading as Essence of Light Photography, hereafter referred to as Essence of Light.

1.2 Workshop means the service being offered to the Client by Essence of Light, on the website www.essence-of-light.com. Bookings on this website are made with Essence of Light.

1.3 Client means any customer or business placing an order with Essence of Light, or on behalf of whom an order has been placed.

1.4 Booking means the completed process through which the Client completes an online booking and sends payment to Essence of Light, and receives confirmation by email that a booking is complete.

1.5 Facilitator means any individual or company working together with or on behalf of Essence of Light in the provision of a workshop.

1.6 Force Majeure means any unforeseen or unusual circumstances beyond the control of Essence of Light such as war or threat of war, terrorist activity, riot, civil strife, industrial dispute, natural or nuclear disaster, fire, flood or adverse weather.

 

BOOKINGS CONDITIONS

2.1 Full payment of the amount stated in the workshop description is required at the time of booking.

2.2 In the case where a Booking is made for more than one person, it is the responsibility of the Client to ensure that all members of their booking party agree to and comply with these Terms and Conditions.

2.3 If a Client has any special dietary or other requests, they should inform Essence of Light of these in advance of the workshop. Essence of Light will try to meet these requests where possible, but regret that sometimes it may not be possible to do so.

If a Client’s participation in the workshop is dependent upon one or more of these requests being fulfilled, then it is the Client’s responsibility to obtain confirmation that they can be accommodated, prior to booking.

2.4 During the workshop, Clients must comply with the instructions of Essence of Light and/or workshop Facilitator(s) at all times. A Client will not be allowed to participate or continue in the workshop if, in the opinion of Essence of Light, the Client’s mental or physical condition is impaired to the extent that they are incapable of caring for themselves or are a nuisance to other workshop participants. Refunds will not be offered in this case, and Essence of Light will not be responsible for any expenses or damages resulting from such a condition or conditions.

2.5 Any items of equipment loaned to a Client during the course of a workshop becomes the responsibility of the Client. Any loss or damage to this equipment must be paid for by the Client.

2.6 The Client will abide by government and council guidance and restrictions with regards to COVID-19. This includes any requirements to quarantine as well as maintain social distancing. The Client will not knowingly attend a workshop while suffering from COVID-19 symptoms, or if they have been told to self isolate by an official organisation such as NHS Test and Trace.

 

CANCELLATIONS / AMENDMENTS

3.1 Any requests for a change of date by the Client must be made by email to jed@essence-of-light.com. A replacement place at a future workshop may be arranged where possible, as determined by Essence of Light. Change of date requests are subject to charges based on how much notice is provided, specifically: Within three days of the workshop date, 100% of the fee. Between 4 and 7 days of the workshop date, 50% of the fee. More than 7 days before the workshop date, 25% of the fee. The stated time frames do not include the actual day of the workshop.

No refunds are possible except under the circumstances outlined in this section.

3.2 Essence of Light reserves the right to alter or cancel any workshop. If an alteration or cancellation becomes necessary, you will have the choice of accepting the change, or accepting an alternative workshop offered by Essence of Light (of equal or lesser value, and where this is of a lower value we will refund the difference), or withdrawing from the contract and accepting a refund of all monies paid to Essence of Light.

Essence of Light will not be held liable for any other costs incurred by the Client in connection with the cancelled workshop (e.g. accommodation, travel, etc.) and recommend that the Client obtains adequate insurance cover for this.

3.3 The minimum number of participants to a workshop is four. If the minimum number of participants is not met Essence of Light reserves the right to cancel the workshop as described in section 3.2

3.4 In the event of Essence of Light or any workshop facilitators being unable to attend due to illness or other circumstances beyond their control, then the workshop will be cancelled, and the provisions of clause 3.2 will come into effect.

3.5 If a workshop is cancelled, you will be informed via the email address you have provided at the time of booking, or by the mobile phone number provided at the time of booking.

3.6 If, due to COVID-19, there is a government or council stipulated lockdown imposed in the workshop area, Essence of Light will cancel the workshop and the provisions of clause 3.2 will come into effect.

3.7 If, due to COVID-19, there is a government or council stipulated lockdown imposed in the Client’s area, or the Client is otherwise unable to travel for any other COVID-19 related reason such as a requirement to quarantine or isolate, then the Client will be able to book on an alternative future workshop offered by Essence of Light or provide a replacement attendee. No refund will be possible.

 

LIABILITIES

4.1 The Client accepts that outdoor photography workshops require flexibility and must allow for alternatives. For a variety of reasons, including inclement weather and the challenges of working with wild animals, all itineraries and descriptions provided must be taken as an indication of what may take place, and not as a contractual obligation on the part of Essence of Light.

4.2 Essence of Light does not accept liability for any loss or additional expense caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness or force majeure. Such losses or additional expenses are the responsibility of the Client.

4.3 Essence of Light does not accept responsibility or liability for death, injury or illness caused to the Client or any other person included in the booking, or for loss of, or damage to their personal property, in the course of a workshop or in transit thereto. Any claims shall be subject to English and Welsh law in respect of any question of liability or quantum, and all proceedings shall be within the exclusive domain of the English and Welsh courts.

4.4 By booking with Essence of Light, the Client accepts that there is always an element of risk associated with any outdoor workshop. The Client warrants that they are fit to travel and are aware of and accept any risks associated with field locations and weather.

4.5 Essence of Light reserves the right to assess whether the Client or any individuals in the particular party can be safely accommodated in the workshop. Essence of Light has an absolute discretion to refuse that Client’s attendance or any member of that Client’s party in the workshop.

4.6 It is the responsibility of the Client to inform Essence of Light at or before the booking if it is necessary to make any special arrangements regarding care or assistance with regard to the Client or any individuals in the Client’s party.

4.7 The Client accepts that suitably qualified medical personnel do not attend Essence of Light workshops. Essence of Light and their Facilitators are not equipped or trained to deal with a medical emergency or to provide care and assistance in the event of an emergency. If you have any medical condition which may need emergency treatment, then you must disclose this at the time of booking to enable Essence of Light Photography to make an assessment as to whether you can be safely accommodated in the workshop.

4.8 By booking with Essence of Light, the Client acknowledges items 4.1 – 4.7 and releases Essence of Light from any liability.

 

INSURANCE AND TRAVEL 

5.1 Travel, personal medical and equipment insurance must be arranged by the workshop Client before the workshop commences. It is the responsibility of the Client to ensure that the insurance provides the appropriate cover/amount of cover for their needs. The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the workshop (whether in whole or in part), personal accident and injury, medical costs, loss or damage of equipment and personal money and belongings.

5.2 It is the responsibility of the Client to ensure that they arrive at the agreed meeting point (house, hotel, or other agreed location) on time. Essence of Light cannot be held responsible for the late arrival of Clients. If a Client arrives late, Essence of Light reserves the right to commence the workshop and accepts no liability for any expenses incurred by the Client arranging their own transport in such an eventuality, or for any workshop content missed by the Client due to their late arrival.

 

COMPLAINTS AND DISPUTES

6.1 If the Client has any cause of complaint, they must immediately bring it to the attention of Essence of Light, or if not possible, to the attention of a Facilitator.

6.2 Essence of Light will do its best to remedy any genuine complaint at that point, but if the issue is unresolved, the Client will notify Essence of Light in writing within 30 days of the workshop.

 

PRIVACY

7.1 Essence of Light is committed to maintaining our Clients’ privacy. Information that you pass on to us will not be passed on to third parties except where necessary in the process of processing a Booking.

7.3 The Client may choose to opt in to the Essence of Light email newsletter. You will always be asked for your permission, and will be entitled to opt out at any time.
